New Industrial plots by HUDA at Gurgaon/Sept.,2011


WHAT IS THE MODE OF ALLOTMENT
The allotment of plots will be on an ongoing first cum first served basis :-
Allotment of Plots to prestigious projects having fixed capital investment of Rs. 30 crores and above shall be made off the shelf by the following committee.
 a)  Secretary Industries Chairman
 b)  MD, HSIDCMember
 c) MD, HFCMember
 d) CA,  HUDAMember ( If allotment is done in a estate
developed by HUDA)
 e) Director IndustriesMember Secretary
For other projects, allotment shall be done on an ongoing basis by the following committee.
 a)  MD,  HSIDC  Member
 b) MD,  HFC Member
 c) CA,   HUDA Member ( If allotment is done in a estate 
developed by HUDA)
 d) Director Industries Member Secretary
Senior-most member shall be the Chairman of the Committee. This committe will meet once in every week to dispose off the applications received during the previous week.
An appeal against the decision of this committee shall lie to the Secretary Industries.
The allotment in respect of plots reserved for NRIs shall be made through the Industrial Assisstance Group.
As per provisions made in the Industrial Policy, the industrial plots are to be allotted on "first come first served basis on the analogy that all applications received within a block of one month shall be treated at par . However, submission of application will not entitle an applicant for allotment of industrial plot. The allotment shall be made after due assessment of the project report and the financial viability and usefulness of the project and other merits of the applicant as decided by the Committee constituted for the purpose.
The available industrial plots would be widely advertised, through national dailies and in case applications received against advertisement are less than the available plots then the interviews / allotments would be done on continuing basis.
10% of Plots in the newly developed Industrial Estates , Growth Centres and IIDCs shall be reserved for NRIs and 10% will be reserved for EOUs with atleast 33% export orders and units having a minimum foreign equity of 33%. The reservation in these two categories shall be interchangeable but the total reservation shall not exceed 20% . However , in case the general category plots have been exhausted in an estate and there is no demand pending from the reserved category candidates , the plots so reserved may be dereserved and allotted to the general category applicants after following the laid down procedure.
Preference shall be given to the following categories of entrepreneurs.
           1. Ex-servicemen
           2. Women Entrepreneurs
           3. Unemployed engineering graduates / polytechnic  / ITI trained candidates.

WHAT IS THE SCHEDULE OF PAYMENT OF A NEW INDUSTRIAL PLOT ?
  • 10% with application.
  • 15%  within 30 days of issuance of allotment letter.
  •  
    Remaining 75% in 5 equal 6 monthly instalments starting from the date of offer of possession.
    Interest @ 18% shall be charged on the balance outstanding only after offer of possession is made..
Rebate equivalent to 20% of the land cost shall be given if the industrial unit starts commercial production within 3 years of offer of possession of industrial plot.
Note: In case of NRIs , the funds towards the price of the plot should come from his/her NRI account.
The application form duly filled in will be received by the developing agency along with the following documents:
An undertaking to the effect that the applicant shall employ at least 75% of his unskilled work force and give preference for other categories to candidates from among the Haryana Domiciles.
10% price of the plot in the form of bank draft infavour of the concerned agency as earnest money.
Copy of the project report with details of implementaion schedule.
Copy of the partnership deed in case of partnership firm or memorandum and articles of association in case of limited company alongwith a copy of certificate of incorporation of the company and details of the promoters and their holding in the company.
Land utilisation plan to justify the requirement of land.
Means of financing.
Any other to be specified by HUDA.
LETTER OF ALLOTMENT
The applicants recommended by the allotment Committte will be issued a regular letter of allotment (LOA) . The applicants will be required to deposit 15% price of plot within 30 days from the date of LOA . In the LOA , plot number, the size, dimensions, zoning and the rate will be indicated.

HOW YOU CAN GET THE EXTENSION IN TIME FOR CONSTRUCTION IN INDUSTRIAL PLOT ?
The allotte will be required to start construction of building within one year of offer of possession and will be required to start commercial production within a period of 3 years from the date of offer of possession. However, in case the allottee is not able to start construction within one year, extension can be granted by the allotting agency for a maximum period of 6 months , if he is able to satisfy the agency that he could not start construction for reasons beyond his control. Similarly, the period for commencement of production can be extended by the allotting agency for maximum period of one year subject to the allottee satisfying the agency that he could not go into production within 3 years of the date of offer of possession for reasons beyond his control and he took effective steps for implementaion of the project. Extension in period for commencement of commercial production beyond three years shall be granted only if 10% of the premissible area has been constructed and effective steps have been taken by the allottee for completion of the project. In such cases extension fees at following rates shall be charged:-

Residential Plot by HUDA

The Residential Plots in a new sector are allotted by inviting applications in the leading newspapers. Allotment is made by conducting the draw from the applications received against the advertisement. All the successful applicants are issued a letter of allotment by including all terms & conditions of allotvevment and mode of schedule of payment. This allotment is made as per the provisions of Haryana Urban Development Authority (HUDA) Act, 1977.

WHAT IS THE SCHEDULE OF PAYMENT ?
The following is the payment schedule for residential plots allotted by draw of lots :-
10% of tentative cost of the plot to be paid as earnest  money at the time of submission of application.
    15% of  the tentative cost of the plot to be paid within 30 days from the date of issuance of letter of allotment.
      Balance 75% of the tentative price of the plot is payable within 60 days in lumpsum without interest from the date of issuance of the allotment letter or in six annual instalments with 9%  rate of interest. The first instalment is payable after  expiry of one year of the date of issue of allotment letter. The interest, on the remaining amount however, accrues from the date of offer of possession.
        The  interest  @ 11%  per annum is chargeable on the  delayed payments for the delayed period as per existing policy.
        HOW CAN YOU GET THE PLOT TRANSFERRED ?

        The following guidelines/policies for transfer of Residential and Commercial Plots allotted by HUDA are applicable w.e.f  7.03.2000
        The transfer of residential / commercial plots wherein either full payment has already been made or laid down / Schedule of payment of instalments is over., whichever is earlier , shall be allowed only through execution of conveyance deed/sale deed. However, in other cases wherein full payment of the plot has not so far been made / Schedule of payment of instalments is not yet over, a maximum four trasfers shall be allowed before final payment.

          Ghaziabad Development Authority/Agreement of Sale/Sample copy/Sept., 2011




          Between the Ghaziabad Development Authority, a body created under the provision of the U.P. Urban Planning and Development Act. 1973, hereinafter called the Authority (which expression shall unless the context does not so admit include its successors and assigns) through its Vice-Chairman/Secretary of the one part and Sri/Smt./Km.................................................……………........................................           2. The Second Party undertakes to pay to the First Party in the installments given hereunder the full amount of sale consideration for purchase from the Authority the said building. 
          3. The Second Party shall pay the afforesaid amount of consideration to the Authority in lump-sum or in half yearly installments in all.             Provided that the Second Party will have the option to pay the entire amount in lump-sum at the time of payment of first or subsequent installments to the Authority in which case it shall not be liable to pay interest @ ................... % thereon, as included in the amount of installments stated above.
          4. The amount aforementioned shall be paid by the Second Party to the first party regularly without fail at the office of the Authority at Hapur Road, Ghaziabad and it will not be necessary for the Authority to make any demand for the same.
          5. In case the total amount of sale consideration as stated above is regularity paid by the second party to the Authority along with the monies payable under the Agreement to leases executed separately between the parties in respect of the land on which the building stands the Authority will on payment of the full amount, execute in favour of the Second Party a deed of sale of the building in question in order to transfer the same absolutely to the Second Party.
          6. The sale deed in question shall be executed in the form prescribed by the Authority and the Draft therefore in force at the time when the same is to be executed in favour of the second party after all payments as stated above have been made by him/her will be acceptable to the Second Party. 
          7. The building in question is situated on Plot No. .................................. block No. ........................of scheme No..................................... at Ghaziabad having by admeasurements......................sq. yds. of land bounded as below :-

            On the West by
            It is agreed that the Authority will remain the full owner of the building till actual sale of the property by way of execution of the saledeed is made in favour of the second party.
          8. The second party will have full right to lay water mains, drains, sewer or electric wires under or above the demised premises and would also have full right and title to all mines and minerals in and under the land in question or any party there of. 
          9. It is clearly understood between the parties that this deed creates no interest in the building in question if favour of the second party and create only a contractual obligation where under on performance in full of the conditions of this agreement the second party would be entitled to obtain from the Authority a deed of sale to transfer the building infavour of the second party on the terms and conditions stated in this deed.
          10. It is also a condition of this agreement that the entire amount of taxes or rates or any other duty whatever imposed by the government or any other authority or local body in respect of the land or the building standing there on shall be paid by the Second Party and the Authority will not be liable to pay the same from the date of the allotment there of to the date of occupation of the same by the second party.
          11. On execution of this agreement and its registration before the Sub-Registrar at Ghaziabad the Authority shall deliver possession of the building and the second party will thereafter be entitled to make a reasonable use of the same. 
          12. The second party will be liable to keep the building in tidy conditions and will keep it neat and clean and will not occasion or causes any nuisance of any kind thereon. 
          13. The second party will be entitled to uses the property in question only for residential purpose and will be entitled to uses it for any other purposes whatsoever. 
          14. The second party will not be entitled to make any additions or alteration in the building in question and will keep it in the condition in which it is given to it till the execution of the deed or sale in its favour as hereinabove mentioned. 
          15. In case any damage is caused to the building on account of natural calamity or violence of any mob or army or any other clamity beyond human control, the loss shall be borne by the Second Party and the Authority will in no case be liable for the same.
          16. The second Party has satisfied itself about the condition and the quality of the building and the material used in constructing the same and it will have no right at all to make any complaint or grievance in respect of the same after execution of this agreement. 
          17. In case Second Party commits a breach of the terms and conditions to this agreement, it would be open to Authority to take appropriate action for eviction of the second party from the property in question and also to charge from the second party compensation for use and occupation of the property at Rs................................per month for the whole duration of its occupation there of. 
          18. It is further made clear between the parties that the second party will pay to the Authority on demand by it any further amount that may on final calculation of costs of the building put up there in may be demanded by the Authority form the Second Party and the Vice-Chairman of the Authority would be the sole judge of the question as to what further amount is due from the Second Party on such final calculation of the cost there of and the Second Party will not be entitled to question the decision of the authority or of its Vice-Chairman in respect thereof. 
          19. It is also a condition of this deed that the Second Party will perform all the terms and conditions of this agreement and executed a separate deed of lease between the parties for demise of the land in question and unless the same are faithfully and truly performed and discharged by the Second Party, the Second Party will not be entitled to obtain a deed of sale of the building in question as contemplated in this deed.
          20. That the costs of execution of this deeds aforesaid as also of this deed shall be borne by the Second Party. 
          21. That after the full and final payment of the building and the lease of land, the second party shall, without fail get executed and sale deed in his favour with in 3 months, failing which it shall be open for the Authority to cancel) the allotment and rescind this agreement. 
          22. It is further made clear that in case it is found that the allotment has been obtained by concealment of fact or by misrepresentation the Authority will have a right to cancel the allotment and rescind this agreement. 
          23. It is further clearly agreed that the terms and conditions of allotment as communicated by the Authority to the Second Party in connection with the allotment of the flat, shall always form part of the agreement and shall be binding on the Second Party.
